Warranty

Work – means all work performed by Contractor under the contract referred to above.

Owner – means the person or entity identified as such in the agreement and is referred to throughout the warranty form as if singular in number.

Contract Documents – for the contract between the Owner and Contractor referred to above.

I. CONTRACTOR’S WARRANTIES AND CORRECTION OF WORK

A. The Contractor warrants to the Owner that all parts, materials, components, equipment and other items used to perform the work are new (unless otherwise specified in the Contract Documents) and suitable for the purpose used and will be of good quality, free from faults and defects and in conformance with the Contract Documents. Work not so conforming to these requirements, including substitutions not properly approved and authorized, may be considered defective.

B. The Contractor shall promptly repair, replace or otherwise correct any of its workmanship and any parts, materials, components, equipment or other items in the Work which contain faults or defects whether such failures are observed by the Owner or Architect before or after Completion of the work as defined in the Contract and referred to above. The Contractor shall bear all costs of correcting such Work covered by the warranties described in this document. The Contractor’s warranties shall continue for a period of ONE year(after the date of Completion of the work as defined in the Contract referred to above or such longer period of time as may be prescribed by the terms of any special warranties required by the

All warranties and guarantees of the Contractor, Subcontractors or its manufacturers and suppliers express or implied, for any part of the work and any materials used therein shall be obtained and enforced by the Contractor for the benefit of the Owner whether or not these warranties have been assigned or otherwise transferred to the Owner.

II. PERFORMANCE DURING WARRANTY PERIOD

A. The Owner will notify the Contractor of the Work which it finds does not satisfy the warranties, and the Contractor shall, within a reasonable timeframe begin to correct, repair, replace faulty work. Under emergency conditions, the Contractor shall immediately take corrective action. Should the Contractor fail to begin such work within such period, the Owner may make the repairs or replacements at the expense of the Contractor. If the Owner determines that immediate action to make repairs, replacements or other corrections is necessary because of emergency conditions or to prevent further loss or damage, the Owner must give notice to the Contractor prior to taking action.

Warranties outlined by Summit Investment Group

• Summit Investment Group provides a non-transferrable one-year workmanship warranty for the service, installation, work to be free from defects from the date of completion. Any claims must be submitted in writing within 10 days of the defect becoming apparent. The following causes/reasons are not covered under intentional misuse, conditions beyond our control (acts of weather), modifications to the work, failure of the site to be prepared in accordance with our specifications prior to commencing work.

Note: The workmanship warranty does not apply to wooden doors, concrete, tile, or paint due to unpredictable factors.

• Galvalume Metal is backed with a 25-year manufacturer warranty and all painted metal is backed with a 40-year manufacturer warranty.

• All warranties related to Summit Investment Group Materials(s) are void if Material(s) are altered or modified.

• Customer will be responsible for doing a final inspection of the project at completion and reporting any defects in writing to Summit Investment Group. Summit Investment Group will assess any defects and take corrective action, if necessary.

• If a manufacturer has discontinued an Item originally installed in your Home, Summit Investment Group cannot be responsible for an exact match. This includes, but is not limited to matching flooring, wood, cabinets, countertops, plumbing and electrical fixtures, stained wood, or trim. Summit Investment Group will try to provide the closest match possible with approval from Customer.

• When addressing a warrantable issue, Summit Investment Group has the choice to repair, replace, or pay the reasonable cost to repair or replace an approved warranted item. If Builder elects to pay the reasonable cost to repair or replace any warranted item, the Warranty on any such item is at that point terminated. The maximum liability of Summit Investment Group shall not exceed the final sales price of the material as stated on the Final Sales Order.

• Customer must provide protection for floors, walls, fixtures, furniture or any other part of the house that may be affected by the repair.
